US judge dismisses child sex abuse charges against actor TIMOTHY BUSFIELD

Sunday, October 18, 2026 - A New Mexico judge has dismissed child sexual abuse charges against American actor and director Timothy Busfield, citing prosecutorial misconduct and procedural errors that undermined the grand jury process.

The ruling, delivered on October 16, 2026, by State District Judge Joseph Montaño, dismissed a four-count indictment against the 69-year-old actor, known for his roles in The West Wing, Thirtysomething and Field of Dreams. The decision marks a significant development in a case that has attracted widespread public attention because of the serious allegations involving two young child actors.

The case arose from allegations that Busfield inappropriately touched twin boys while working on the television series The Cleaning Lady in Albuquerque, New Mexico, between 2022 and 2024. Prosecutors brought the charges in February 2026, but Busfield consistently denied the allegations and pleaded not guilty.

In dismissing the indictment, Judge Montaño ruled that prosecutors had failed to act fairly and impartially, including by improperly instructing grand jurors on procedures for requesting additional witnesses. The judge said these actions undermined the integrity of the proceedings. Busfield’s legal team welcomed the decision, while prosecutors confirmed they were evaluating their next steps.

Despite the dismissal, the case may not be over. The judge’s ruling allows prosecutors to pursue a new indictment, meaning further legal proceedings remain possible. The decision does not establish that the allegations were false or determine the underlying facts of the case; it addresses serious procedural problems in the original grand jury process.

The development also highlights the importance of ensuring that criminal investigations involving allegations of child abuse follow fair and legally sound procedures. As prosecutors consider their options, attention will remain focused on whether the case returns to court and what the next steps mean for Busfield, the families involved and the pursuit of justice.
